Terms And Conditions
Affiliate Agreement and Terms and Conditions of Service
This Affiliate Agreement (this "Agreement") shall be the sole document governing the relationship between the affiliate program operator Bet Phoenix Casino Affiliate Program ("The Program") and any individuals and/or commercial entities (an "Affiliate") that wish to promote Bet Phoenix Casino (the Site).
By joining the Bet Phoenix Affiliate Program you acknowledge you have read and agreed to abide by the terms and conditions set forth in this document.
1. Affiliate Program Participation.
To become an Affiliate for Bet Phoenix Casino the Affiliate must complete the Affiliate application. The Program will promptly review the application and, at their sole discretion, approve or reject the account. An affiliate site may be deemed non-suitable for participation if it includes, although not limited to, any of the following materials:
Pornographic or Obscene Content
Hate Content that is directed at any particular race, religion or ethnic group.
Unlawful Behavior including, but not limited to; warez, hacking, copyright infringement, or any other activity deemed illegal by local, state, or federal law.
Inflammatory content related to violence, extreme political or religious positions or other topics considered offensive by the general public.
2. Grant of Promotion and Distribution License.
The Program grants The Affiliate a non-transferable, non-exclusive right to use the marketing materials provided in order to market and promote The Bet Phoenix Casino site. This grant of License shall be limited to the Terms and Conditions detailed in this document. Any and all other licenses and rights not expressly granted on this page are reserved exclusively by Bet Phoenix Casino.
3. Bet Phoenix Casino Affiliate Program Obligations.
The Program will provide the Affiliate with the Marketing Material that the affiliate can use to promote and market the Bet Phoenix Casino Site and services contained therein.
The Program will track and register Customer activity and the purchases made as appropriate. This activity will be reflected in the individual Affiliate's Stats. Bet Phoenix Casino reserves the right to refuse Customers and close their accounts as applicable and in accordance to our Customer Terms and Conditions agreement.
The program will provide the affiliate with reports detailing the activity of the players sent by the affiliate. The Program reserves the right to change the content, frequency and form of such reports. To access the mentioned reports, affiliates will need to use the Log in and password as provided by The Program.
The Program will provide the Affiliate with payment based on the income Bet Phoenix Receives from purchases and play generated by the Customers sent from the affiliate's marketing efforts as specified in section 6. Compensation and Commissions. Additionally no payment shall be made unless Bet Phoenix receives payment itself. Bet Phoenix has the right to change payment terms at their sole discretion and without prior warning.
The Affiliate shall only participate in marketing activities that do not violate any law and which reflect in a positive manner on the Bet Phoenix Casino brand. Furthermore, The Affiliate agrees to promote The Program in a manner that is in accordance to the content and branding strategy employed by Bet Phoenix Casino. The program reserves the right to approve or deny any marketing used by The Affiliate.

The Affiliate shall not, under any circumstances, hold The Program liable for any claims placed against Bet Phoenix Casino, the affiliate or any other individual or corporate identity in relation to The Affiliate's Marketing Efforts.
The Affiliate is solely responsible for the costs associated with advertising the services provided by Bet Phoenix Casino.
Multiple Affiliate Accounts are strictly prohibited unless prior written permission is provided by the Program. Affiliates that violate policy 4.E. may be subject to suspension and all commissions withheld.
Bet Phoenix Casino Affiliate Program reserves the right, in their sole discretion to change, amend, add or remove any part of this agreement, at any time, and without prior warning. It is the responsibility of the affiliate to be aware of such changes.
5. Confidentiality and Non-Disclosure.
The information provided by the Program to the affiliate shall be considered confidential. The Affiliate agrees to a non-Disclosure of such information. Information provided shall remain strictly confidential and for the sole private use of the affiliate. Any stats, affiliate announcements or communication, and affiliate back end access shall not be disclosed to the general public except to the extent required by legal processes.
6. Compensation and Commissions.
The compensation structure for the affiliate shall be based on commissions of Bet Phoenix Casino's earnings from the players sent by the Affiliate. The structure and level of such commissions is:
| Level 1 – Up to $10,000 | In Monthly Player Loses 25% Commission |
| Level 2 – $10,001-20,000 | In Monthly Player Loses 30% Commission |
| Level 3 – $20,001-50,000 | In Monthly Player Loses 35% Commission |
| Level 4 – $50,001 + | In Monthly Player Loses 40% Commission |
4% Commission on All Sub-affiliates Payments for Life. Commissions are calculated based on ANW. So a working example would be: $15,000 In Monthly Players Loses - $1,000 in chargebacks = $14,000. The affiliate would then receive 30% of $14,000 which is $4,200.00.
In the event of the affiliate generating a negative commission during any month, this negative will be eliminated so that the affiliate commission begins at zero each month. The exception to this rule shall only happen in the event of a charge back. The Program shall process the commissions earned by the affiliate before the 10th business day of the month after commissions were generated. Bet Phoenix Casino Affiliate Program shall in no event be held liable in any manner whatsoever for any possible delays in delivery of payment, independent of whether this delay is caused by the Affiliates or the Program's decisions and actions.
Payment shall be provided to Affiliates via the method selected by the affiliate in his or her account. The payment shall be made to the name and financial information found in the Affiliate's account. Bet Phoenix Casino shall be in no way held responsible for payments sent to the wrong name or financial information if so listed in the affiliate's account. It is the sole responsibility of the affiliate to maintain their affiliate information confidential and secure. Any un-authorized changes made to the affiliate's account due to a breach in the Affiliate's account security are the responsibility of the affiliate. All affiliate payments shall be made in United States Dollars (USD)
Restrictions:
Unless prior written consent provided by Bet Phoenix Casino Affiliate Program, The Affiliate is limited to 1 account.
In no event may an affiliate on revenue share earn more than a corresponding percentage of his combined player's deposits as 1st tier commissions. So that if an affiliate is on 30% Revenue Share, and his players deposit $1,000.00 during a calendar month with no withdrawals, then the affiliate may not earn more than his corresponding share of $300.
The Affiliate shall NOT earn commission on the payments to Second-tier affiliates if the Affiliate and the Second Tier affiliate hold any of the following relationships: Employee, immediate family member, director, shareholder, agent or in the case the two live in the same household or share the same IP.
The Program reserves the right to pass on any and all financial loses associated with the Affiliates account which may arise due to Fraudulent activity by the affiliate, the Affiliates Employees, Customers and/or Players.
The Program may lock the account of the Affiliate and withhold all earnings if it is deemed, at the sole discretion of The Program that the affiliate is knowingly abusing of the affiliate program to ensure a profit in a manner that the program is not designed for.
The Affiliate shall not earn any commissions from his own player account, nor from the player account of the Affiliate's immediate family members, associates, employees or from any individual residing in the same household or coming from the same IP as the affiliate. Bet Phoenix Casino reserves the right to shut down any affiliate and/or player accounts that are in violation of this section 6.E.e.
Any disputes by the Affiliate regarding the commissions paid shall be lodged with The Program within 60 days of said commission being paid. If no objection is placed within that time frame, then the payment sent shall be deemed received in full satisfaction.
The Program and the Affiliate are independent contractors. Nothing in this agreement shall create any other relationship between the two parties including, but not limited to; employment, partnership, franchise, sales representative or agency. The affiliate has no authority to make any offers or statements on the affiliate's web site or otherwise that contradicts this term.
8. Exclusivity, Non-Competition and Ownership of Service name.
The affiliate understands that The program owns and retains all rights, including copyright on images, text, software and any other materials provided to the affiliate. The affiliate shall not stake claim on any copyrighted material including but limited to trademarks, copyright, or logo.
The affiliate shall not register any trademark or other proprietary right over the names, logos, slogans, or other copyrighted materials found on the properties of Bet Phoenix Casino with any government, judicial or any authority or domain name registrar. Furthermore the affiliate shall not assist or attempt to assist any 3rd party in such actions. The affiliate is forbidden from using any of the Bet Phoenix Casino brand names or slogans in any business name, domain name, trademark, logo or to affix such materials to any non-Bet Phoenix Casino Brands.
The affiliate shall not deface, alter, overprint or erase any part of the copyrighted materials provided by the Bet Phoenix Casino Affiliate Program.
The intellectual property provided to the Affiliate by the program cannot in any way whatsoever be sub-licensed in any manner.
The affiliate acknowledges that the Program may enter into other agreements of any type with any and all third parties or services the Program deems fit in their sole discretion.
9. Term of Duration and Events of Default.
The agreement between The Affiliate and The Program shall be deemed valid from the moment Bet Phoenix Casino Affiliate Program notifies the affiliate of his or her acceptance. The agreement will remain effective until terminated by either party. Either party may terminate the agreement with immediate effect upon notification and with no further obligations toward each other.
The Program may terminate the agreement and withhold all commissions earned by the affiliate in the event of any abuse by the affiliate party, as defined in the sole discretion of the Bet Phoenix Affiliate Program.
By participating in the Bet Phoenix Casino affiliate program the Affiliate acknowledges that the Affiliate party has all necessary rights, permissions, business permits and licensing needed to operate their affiliate business under applicable laws and regulations.
The Affiliate agrees to indemnify and hold harmless the Bet Phoenix Affiliate program and all the Bet Phoenix Casino associates, officers, directors, employees, agents, shareholders and partners against all liabilities, claims, damages, causes of action and costs that are connected in any way to any activity of Bet Phoenix Casino for, and not limited to, any breach of contract on, non performance or fault on the part of Bet Phoenix and any of their employees and associates.
In no event shall Bet Phoenix Affiliate Program be liable to the Affiliate party for more than the amount owed to the Affiliate in commissions as defined in these terms and conditions.
The Bet Phoenix Affiliate program and all of their associates, officers, directors, employees, agents, shareholders and partners shall not be liable, in contract, tort or any breach in any way for:
Loss of income or contracts
Loss of reputation or good name
Any and All indirect and unforeseen consequential loses
Bet Phoenix Casino may modify these Terms and Conditions, at their sole discretion, at any time, with immediate effect and without prior notice. The update of this document constitutes sufficient notice of such modification. Any modifications will go into effect immediately upon being available on the World Wide Web. Any continued participation in the program after any possible change represents binding acceptance of the change. The only recourse in the event the affiliate does not accept such change is to terminate the agreement. The affiliate program will make an effort to contact affiliates regarding any changes, but is in no way liable for failure to do so.
It is strictly forbidden for anyone under the age of 18 to gamble online. Bet Phoenix Casino has a strong moral obligation to fight underage gambling. Bet Phoenix Casino will ensure in every way possible that no underage person shall place any wager on any of their brands. Any affiliate found trying to circumvent, or help circumvent the Efforts to fight Under Age Gambling efforts shall have their account closed and profits forfeit.
Affiliates may not directly or indirectly use the Bet Phoenix Affiliate program to participate, benefit or be party to any money laundering or other illegal activities.
In the event The Program, in The Program's sole discretion, finds an affiliate guilty of such activity as detailed in section 13.A. of this agreement, Bet Phoenix reserves the right to: suspend the affiliates account, withhold any and all commissions due, and report such affiliate to the corresponding authorities, if, at the absolute discretion of Bet Phoenix, it is obligated by law to do so.
The Program makes no expressed or implied warranties regarding the effectiveness, proper function, profitability and any and all other expectations the affiliate may have toward the program. Furthermore Bet Phoenix makes no representations that the web site or services provided will be un-interrupted or error free. The program shall not be liable or responsible for any loses of any kind arising from interruptions or errors.
In the event of discrepancies between this document and any translations or other reproductions, the meanings found on the English version located on this webpage shall prevail.
This document and the relationship between the Affiliate and the Program shall be governed and construed by the laws of the Republic of Costa Rica. Shall any part of this document be found to be non-applicable or invalid for any reason, this shall not affect, to the extent applicable by law, the other parts of this document or the bond created from such and the Terms and Conditions remaining shall continue effective in full force.
